One of the biggest decisions you’re going to have to make after a personal injury is whether or not you’re going to take the case to court. In many cases this isn’t necessary. Only between 4% and 5% of cases actually become personal injury lawsuits, so don’t feel compelled to take an aggressive legal stance against the party or parties responsible for your injury. There are, however, a few things you absolutely need to do when you settle injuries out of court.
1. Document All Evidence
One thing you absolutely need to do if you’re going to settle injuries out of court is to document all of your injuries and losses. The time immediately following an accident or injury is very stressful, but this is when evidence collecting needs to begin. Take notes and pictures of all of your injuries. Make sure to seek medical attention and that the records are accurate and that you keep track of all medical expenses.
2. Hire a Lawyer
You should hire a personal injury attorney as soon as you can after the accident occurs. This may not seem necessary if you aren’t going to go to court, but personal injury lawyers are instrumental in settling cases out of court. They will be able to advise about the process, know precedents for past cases like yours, and help you keep track of relevant losses.
3. Negotiate
When it comes times to settle with the insurance company, know that you do not have to accept their offer. Your settlement should be a combination of your monetary losses and your pain and suffering. You and your lawyer should formulate the amount you expect and work together to negotiate with the insurance company to make sure that you are properly compensated.
